1Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you (the "User") and Buy Sell HoReCa ("Platform," "we," "us," or "our"). Our platform acts solely as an intermediary marketplace enabling individuals and businesses to list, discover, buy, and sell used and refurbished HoReCa equipment and running businesses. Buy Sell HoReCa is not a buyer or seller in any transaction and is not a party to any agreement between users.

2Eligibility

By using Buy Sell HoReCa, you confirm that:

• •You are at least 18 years of age.
• •You are legally capable of entering into binding contracts under applicable Indian law.
• •You are either an individual or a duly registered business entity operating in India.
• •You are not barred from using the platform under any applicable law, regulation, or court order.

3User Conduct

As a member of the Buy Sell HoReCa community, you agree to:

• •Provide accurate, truthful, and complete information about any used or refurbished HoReCa equipment or business you list, including condition, age, defects, and ownership history.
• •Communicate honestly, respectfully, and professionally with other users of the platform.
• •Possess the legal authority, title, or rights to sell or transfer any equipment, setup, or business listed on your account.
• •Accurately represent the condition of listed items — whether used, refurbished, or requiring repair — and not misrepresent items as being in better condition than they are.
• •Comply with all applicable Indian laws, including the Sale of Goods Act, Consumer Protection Act, and any industry-specific regulations related to HoReCa equipment.

4Prohibited Activities

To maintain the integrity and safety of the marketplace, users must not:

• •List new equipment falsely claiming it to be used or refurbished.
• •Post misleading images, fabricated specifications, or inaccurate condition descriptions.
• •Attempt to conduct transactions outside the platform in order to bypass platform processes, fees, or verification.
• •Engage in fraudulent activity, impersonation, or misrepresentation of identity or ownership.
• •Post listings for stolen, encumbered, or legally disputed equipment or businesses.
• •Harass, threaten, or engage in abusive communication with other users or platform staff.
• •Violate any applicable law, regulation, or third-party rights through use of the platform.

5Marketplace Integrity

Buy Sell HoReCa is committed to maintaining a safe and transparent marketplace. We reserve the right to:

• •Remove any listing that violates these Terms and Conditions or our listing guidelines.
• •Suspend or permanently ban any account found to be engaging in prohibited activities.
• •Request supporting documents (such as purchase invoices, ownership proof, or GST details) to verify any listing or user identity.
• •Report fraudulent activity to appropriate legal authorities where necessary.

Buy Sell HoReCa does not guarantee the accuracy of user-generated listings and encourages all buyers to conduct their own due diligence before completing any transaction.

6Transactions and Liability

Buy Sell HoReCa is a listing platform and does not itself buy, sell, or take custody of any equipment or business. Accordingly:

• •All transactions are solely between the buyer and seller. Buy Sell HoReCa is not responsible for the quality, condition, legality, or delivery of any listed item.
• •Users are solely responsible for inspecting items, negotiating terms, and fulfilling their obligations in any transaction.
• •Buy Sell HoReCa shall not be held liable for any loss, damage, dispute, or financial harm arising out of transactions between users.

We strongly recommend users verify ownership documents, inspect equipment in person where possible, and use secure payment methods before completing any purchase.

7Platform Rights and Intellectual Property

The Buy Sell HoReCa name, logo, platform design, content curation systems, and underlying technology are the proprietary intellectual property of Buy Sell HoReCa and its licensors. Users are granted a limited, non-exclusive, non-transferable licence to access and use the platform solely for its intended purpose of buying and selling used and refurbished HoReCa equipment.

You may not copy, reproduce, modify, distribute, or create derivative works from any part of the platform without prior written consent.

By posting listings or content on the platform, you grant Buy Sell HoReCa a non-exclusive, royalty-free licence to display, promote, and distribute that content as part of the marketplace's operations.

8Amendments

Buy Sell HoReCa reserves the right to update or modify these Terms and Conditions at any time. Users will be notified of material changes via email or a prominent notice on the platform. Continued use of the platform after such changes constitutes acceptance of the revised terms.

9Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
