Welcome to Buy Sell HoReCa. Buy Sell HoReCa is India's trusted marketplace to buy and sell used and refurbished HoReCa equipment, open to individuals and businesses across the Hotel, Restaurant, and Café industry. This policy describes our practices regarding the collection, use, disclosure, and protection of your personal data in accordance with India's Digital Personal Data Protection Act, 2023 (DPDPA) and other applicable laws. By using our platform, you consent to the practices described in this policy.

2Information We Collect

We collect the following categories of information:

a) Personal Data

  • Name, phone number, and email address provided during registration or enquiry.
  • Business name and GST number (where applicable, for business accounts).

b) Listing Data

  • Technical specifications, images, condition details, and pricing of used or refurbished HoReCa equipment or business setups you post on our platform.
  • Ownership or verification documents submitted to authenticate a listing.

c) Usage & Technical Data

  • IP address, browser type, device type, and operating system.
  • Pages visited, search queries made, listings viewed, and time spent on the platform.
  • Cookies and similar tracking technologies (see Section 6 below).

d) Communication Data

  • Messages exchanged between buyers and sellers through the platform's communication tools.
  • Correspondence with our support or compliance team.

e) Address Book & Contacts Data (Mobile App)

When you explicitly choose to use the "Sync Contacts" feature in our mobile application, with your prior affirmative consent, we access and securely transmit names, phone numbers, and email addresses from your device contact book to our secure servers (bshoreca.com).

  • Purpose: To help you discover, connect, and network with chefs, managers, restaurant operators, and equipment dealers you already know who are registered on BS HoReCa.
  • Protection & Non-Sale: Contact data is encrypted in transit using HTTPS/TLS. We strictly do not sell, rent, monetize, or publicly display your raw contact book data, nor do we send unsolicited marketing to your contacts.
  • Control: You can disconnect synced contacts and remove cached contact matches at any time via in-app Privacy Settings or by requesting data erasure.

f) Geolocation Data (Mobile App)

  • With your runtime permission, we access your device's approximate and precise GPS coordinates while the app is in the foreground to display nearby kitchen equipment listings, local café/restaurant setups, and nearby HoReCa job opportunities.
  • We do not track or record your background location when the application is closed.

g) Third-Party Authentication & Crash Analytics

  • Firebase Authentication & Services: We use Google Firebase for secure OTP generation, phone verification, and push notifications.
  • Truecaller SDK: Users may optionally verify their mobile number via 1-tap Truecaller verification. Truecaller processes phone numbers under its verified developer protocol.
  • Sentry Crash Reporting: Diagnostic crash logs and performance telemetry are collected to maintain app stability. All personal identifiable details and input fields are masked.

3Legal Basis for Processing

We process your personal data on the following lawful grounds under the DPDPA 2023:

  • Consent:You have given explicit consent during registration or at the point of data collection.
  • Contractual:Necessity for processing to provide you with our marketplace services.
  • Legitimate:Interests in processing certain usage data to improve platform security, detect fraud, and enhance user experience.
  • Legal:Obligation to process data where required by applicable Indian law or a court order.

4How We Use Your Information

We use your data for the following purposes:

  • Connecting buyers and sellers of used and refurbished HoReCa equipment seamlessly.
  • Authenticating users and reviewing listings to promote a safe and transparent marketplace.
  • Sending relevant updates, listing alerts, and platform notifications based on your activity.
  • Processing enquiries, support requests, and disputes between users.
  • Improving our platform features, search experience, and overall marketplace quality.
  • Detecting, preventing, and responding to fraud, abuse, or illegal activity.
  • Complying with applicable legal and regulatory requirements.

5Data Sharing & Third Parties

We do not sell your personal data. We may share your information only in the following circumstances:

  • Marketing & advertising cookies: Used to measure advertising campaign performance and reach relevant audiences on platforms such as Meta (Facebook Pixel). These are only activated with your explicit consent via our cookie preference banner.

Account & Data Deletion (Web & Mobile)

In compliance with Google Play Developer Policies and the DPDPA 2023, you have the absolute right to delete your account and all associated personal data.

In-App Deletion: Go to Profile → Settings → Data & Privacy → Delete Account. Confirming deletion permanently purges your authentication, profile, marketplace listings, chats, and uploaded media within 30 days.

Web Deletion Request: If you no longer have the app installed, you can submit an instant deletion request via our dedicated Web Account Deletion Portal or email us directly at support@buysellhoreca.com.

9Children's Privacy

Buy Sell HoReCa is not intended for use by individuals under the age of 18. We do not knowingly collect personal data from minors. If we become aware that a minor has provided us with personal data, we will promptly delete it. If you believe a minor has registered on our platform, please contact us immediately.

Buy Sell HoReCa implements industry-standard security protocols to protect your personal and business data. We use encrypted data transmission (HTTPS/TLS) and secure cloud storage to safeguard your information. Access to personal data is restricted to authorised personnel only. While no system can guarantee absolute security, we are committed to continuously improving our data protection practices and responding promptly to any security concerns or breaches.
